Terms of Service

Plain English summary: LotScout provides real estate data lists for marketing purposes. You are responsible for how you use the data, including compliance with all applicable laws (TCPA, CAN-SPAM, state DNC laws). We are a data service, not a licensed real estate broker. Don't abuse the data. Don't sue us for how your campaigns perform.

1. Agreement to Terms

By accessing or using LotScout ("Service," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all subscribers, users, and anyone who accesses or uses LotScout in any way.

2. Description of Service

LotScout provides real estate property data lists compiled from publicly available county assessor records and licensed third-party data providers. Lists may include property owner names, mailing addresses, phone numbers (via skip tracing), and property details. The Service is intended solely for lawful marketing, investment research, and lead generation purposes.

LotScout provides DNC flags as a courtesy. It is your responsibility to independently verify DNC status and comply with all applicable laws. LotScout is not a compliance service and does not guarantee the accuracy of DNC data.

6. Data Accuracy Disclaimer

LotScout data is sourced from public records and third-party providers. We make no warranties, express or implied, regarding the accuracy, completeness, timeliness, or fitness for a particular purpose of any data. Property ownership, contact information, and assessed values may change. You use the data at your own risk.

7. Not a Real Estate Brokerage

LotScout is a data and technology service. We are not a licensed real estate broker, agent, or investment advisor. Nothing in our service constitutes real estate, legal, financial, or investment advice. You should consult licensed professionals before making real estate investment decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOTSCOUT AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to: loss of profits, lost deals, TCPA violations, regulatory fines, or any damages arising from your use or misuse of the data.

Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless LotScout, its owners, officers, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the data; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your marketing campaigns conducted using LotScout data.

11. Termination

LotScout reserves the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms, abuse of the Service, or any other reason at our sole discretion. Upon termination, your right to access data ceases immediately.

12. Intellectual Property

The LotScout platform, including its design, software, branding, and methodology, is owned by LotScout / Summit Land Group. You are granted a limited, non-exclusive, non-transferable license to use the data solely for the purposes described in these Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any disputes shall be resolved by binding arbitration in Hennepin County, Minnesota, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify active subscribers of material changes via email.
